Formulation Commitment. 3.1.1 Before the Effective Date, ▇▇▇▇▇▇▇▇▇ shall provide the vendor of any Covered Product the Lead Free concentration standards of Section 2.3 and instruct its vendors not to incorporate any raw or component materials into such product, especially brass materials, that do not meet or exceed the Lead Free concentration standards of Section 2.3. 3.1.2 After the Effective Date, should ▇▇▇▇▇▇▇▇▇ arrange for the manufacture or other production of Covered Product with a new vendor, ▇▇▇▇▇▇▇▇▇ shall also provide such vendor the Lead Free concentration standards of Section 2.3 and instruct such vendor not to incorporate any raw or component materials into such product, especially brass materials, that do not meet or exceed the Lead Free concentration standards of Section 2.3. For a period of three years following the Effective Date, ▇▇▇▇▇▇▇▇▇ shall maintain copies of all testing it obtains of new vendor Covered Products demonstrating compliance with this Section 3, shall maintain copies of material vendor correspondence relating to the Lead Free standards and shall produce such copies to Davia within thirty (30) days of receipt of written request from Davia. 3.1.3 As of the June 1, 2018, ▇▇▇▇▇▇▇▇▇ shall not manufacture, cause to be manufactured, order or cause to be ordered any Covered Product that is not Lead Free. For every Lead Free Covered Product ▇▇▇▇▇▇▇▇▇ manufactures, causes to be manufactured, orders or causes to be ordered after June 1, 2018, for a period of three years following the Effective Date, ▇▇▇▇▇▇▇▇▇ shall maintain copies of all testing it obtains of such products demonstrating compliance with this section, and shall provide copies of any such testing to Davia within thirty (30) days of receipt of written request.
Formulation Commitment. 3.1.1 No later than the Effective Date, Argento shall provide the DEHP Free Standards, to its then-current supplier(s) of Covered Products that will be sold or offered for sale to California consumers and shall instruct each supplier to use reasonable efforts to provide Covered Products that comply with such DEHP Free Standard. In addressing the obligation set forth in the preceding sentence, Argento shall not employ statements that will encourage the supplier(s) of Covered Products to delay compliance with the DEHP Free Standard. Upon request, Argento shall provide ▇▇▇▇▇▇ with copies of such supplier notification and ▇▇▇▇▇▇ shall regard such copies as confidential business information.‌‌ 3.1.2 After the Effective Date Argento shall not manufacture, cause to be manufactured, purchase or otherwise obtain any Covered Product for distribution or sale in the United States, or for distribution to or sale to any retailer that Argento reasonably understand maintains retail outlets in the United States, that is not DEHP Free.
Formulation Commitment. As of the Effective Date, Rimports shall not manufacture, import, distribute, sell, or offer the Products for sale in the State of California unless: (i) the Products are Formulated Products pursuant to Section 2.2; or (ii) Rimports provides a clear and reasonable warning pursuant to Section 2.3. The Parties agree and intend that Rimports’ compliance with the terms of this Resolution Agreement shall constitute its compliance with Proposition 65 with respect to exposures to lead from the Products.
Formulation Commitment. As a material term of this Agreement, Godinger represents that, promptly after receipt of the Notice, it began investigation into their vendor’s material concentration compliance for Lead. 3.1.1 After the execution of this Agreement, should Godinger arrange for the manufacture or other production of Covered Product with a new vendor, Godinger shall provide such vendor the Lead Free concentration standards of Section 2.3 and instruct its vendors not to incorporate any raw or component materials into such product, especially brass materials, that do not meet or exceed the Lead Free concentration standards of Section 2.3.
