The 'Formal Level #1: Superintendent' clause establishes the first step in a formal dispute resolution process, designating the Superintendent as the initial authority to address and resolve disputes or issues arising under the contract. Typically, when a disagreement occurs, the parties must submit their concerns in writing to the Superintendent, who then reviews the matter and provides a decision or recommendation within a specified timeframe. Formal Level #1: Superintendent. If a complaint is not resolved in a conference between the affected bargaining unit member(s) and his/her immediate supervisor, the complaint may be formalized as a grievance. A formalized grievance shall be submitted in writing within ten (10) days of the meeting between the supervisor and the affected bargaining unit member(s). A copy of the grievance shall be sent to the union and the immediate supervisor. The immediate supervisor shall, within five (5) days of the receipt of the grievance, render a written decision. A copy of this decision shall be forwarded to the grievant(s) andtheunion. The writtengrievanceshallinclude:
1. Identification of the grievant(s).
2. The facts upon which the grievance is based.
3. The applicable portion(s) of the Agreement allegedly violated, misinterpreted or misapplied.
4. The relief sought.
5. The date on which the alleged grievance occurred.
6. The date on which the grievance is being filed.
7. A signature of the grievant.
