Forfeiture of Owner Utility’s Rights. No Permit granted under this Agreement shall extend to any Pole on which the Attachment of Attaching Utility's Facilities would result in a forfeiture of Owner Utility’s rights. Any Permit, which on its face would cover Attachments that would result in forfeiture of Owner Utility's rights, is invalid. Further, if any of Attaching Utility's existing Facilities, whether installed pursuant to a valid Permit or not, would cause such forfeiture, Attaching Utility shall promptly remove its Facilities upon receipt of written notice from Owner Utility. Owner Utility will perform such removal at Attaching Utility’s expense not sooner than the expiration of thirty (30) calendar days from Owner Utility’s issuance of the written notice.

To allow time for obtaining and analyzing the data and updating the billing system, this billing change will take place on the first day of the second month following the end of the quarter (e.g. May 1 for 1Q, Aug 1 for 2Q, etc.). There will be no adjustments to the amount billed for previously billed LSRs.   • Uncontrollable Forces Tariff Provisions Section 14.1 of the CAISO Tariff shall be incorporated by reference into this Agreement except that all references in Section 14.1 of the CAISO Tariff to Market Participants shall be read as a reference to the Participating Generator and references to the CAISO Tariff shall be read as references to this Agreement.

  • Surveys, Permits, and Regulations The Owner shall furnish all surveys unless otherwise specified. Permits and licenses of a temporary nature necessary for the prosecution of the Work shall be obtained and paid for by the Contractor. Permits, licenses, and easements for permanent structures or permanent changes in existing facilities shall be obtained and paid for by the Owner unless otherwise specified. The Contractor and its Subcontractors must pay any municipal or county occupational licenses, taxes, or fees, if any. The Contractor shall give all notices and comply with all laws, ordinances, rules, and regulations bearing on the conduct of the Work. If the Contractor observes that the drawings or specifications are at variance with any such laws, ordinances, rules or regulations, he shall promptly notify the Owner in writing, and any necessary changes shall be adjusted as provided in the Contract for changes in the Work. If the Contractor performs any Work knowing it to be contrary to such laws, ordinances, rules or regulations without such notice to the Owner, he shall bear all costs arising therefrom. Nothing in this paragraph shall be construed to impose design responsibility on the Contractor except as noted in the Contract Documents.

  • Zoning Borrower shall not initiate or consent to any zoning reclassification of any portion of the Property or seek any variance under any existing zoning ordinance or use or permit the use of any portion of the Property in any manner that could result in such use becoming a non-conforming use under any zoning ordinance or any other applicable land use law, rule or regulation, without the prior consent of Lender.

  • Restriction of Shareholders / Owners’ Liability 17.8.1 Parties expressly agree and acknowledge that none of the shareholders of the Parties hereto shall be liable to the other Parties for any of the contractual obligations of the concerned Party under this Agreement. You sha l also not (i) impair anyone else from using the Services or interfere with the proper functioning of the Services; ( i) access the Services (including by use of robots, scripts, spiders or other automated means) other than via the means provided by us; ( i) misrepresent your identity in any way; (iv) overburden the Services in any way; and/or (v) violate any law, rule or regulation in connection with your use of or access to the Services.

  • Retention of Ownership Notwithstanding anything to the contrary herein contained, ownership of all materials brought onto the erf or building site shall remain vested in the contractor until such time as all amounts due in terms of this agreement has been paid in full.
