Common use of Forecasts and Budgets Clause in Contracts

Forecasts and Budgets. In addition to the business plan required to be delivered pursuant to the last sentence of this Section 5.03(g), as soon as available and in any event no later than 45 days after the end of each Fiscal Year, the following prepared by management of the Issuer, in form satisfactory to the Agent: (i) balance sheets, income statements and cash flow statements on a monthly and annual basis for such Fiscal Year; (ii) balance sheets, income statements and cash flow statements on an annual basis for each Fiscal Year thereafter until the Termination Date; (iii) a selling, general and administrative expense budget and a capital expenditure budget for the Obligors for each Fiscal Year in form and substance reasonably satisfactory to the Agent, and (iv) any other information the Agent may reasonably request. Not less than 45 days before the beginning of Fiscal Years 2008 and 2009, the Parent shall deliver, or shall cause the Issuer to deliver, a business plan of ITC^DeltaCom, Inc. which sets forth the business plan for such Fiscal Year as proposed by management and approved by the board of directors of the Parent.

Not less than 45 days before the beginning of Fiscal Years 2008 and 2009, the Parent shall deliver, or shall cause the Issuer Borrower to deliver, a business plan of ITC^DeltaCom, Inc. which sets forth the business plan for such Fiscal Year as proposed by management and approved by the board of directors of the Parent.
