Forecast Volume Clause Samples

Forecast Volume. The purchase price and the other terms and conditions of such sales shall be as specified in said purchase orders and order acknowledgments containing Seller’s Standard Terms and Conditions (a copy of which is set forth on Exhibit C attached hereto); provided, however, in the event of any conflict or inconsistency between or among the terms of this Contract, the purchase orders, and the order acknowledgments containing Seller’s Standard Terms and Conditions, the conflict or inconsistency shall be resolved by giving precedence in the following order: (i) this Contract, (ii) the order acknowledgements containing Seller’s Standard Terms and Conditions, and (iii) the purchase orders.
