The supplier will use reasonable endeavours to estimate the maximum Sync Rate prior to Activation, but The Customer accepts these are conditions beyond The Supplier’s control. No remedy is offered should a Rate-Adaptive Service fail to operate to Customer’s expectations or estimated Bandwidth or Sync Rates and The Supplier shall not be liable for such failure in contract, tort (including negligence) or otherwise.
