Common use of Flood Zone Clause in Contracts

Flood Zone. Except as disclosed in the Surveys delivered to Lender or in the flood determination obtained by Lender prior to the Closing Date, none of the Improvements on any Individual Property are located in an area as identified by the Federal Emergency Management Agency as an area having special flood hazards, or, if so located, the flood insurance required pursuant to Section 6.1(a)(i) is in full force and effect with respect to such Individual Property.

Flood Zone. Except as disclosed may be set forth in the Surveys any flood certificate delivered to Lender or in connection with the flood determination obtained by Lender prior to the Closing DateLoan, none of the Improvements on any Individual the Property are located in an area as identified by the Federal Emergency Management Agency as an area having special flood hazards, hazards or, if so located, the flood insurance required pursuant to Section 6.1(a)(i) is in full force and effect with respect to such Individual the Property.

Flood Zone. Except To the best of Bxxxxxxx’s knowledge, except as disclosed in shown on the Surveys delivered to Lender or in the flood determination obtained by Lender prior to the Closing DateSurvey, none of the Improvements on the Property (or any Individual Property portion thereof) are located in an area as identified by the Federal Emergency Management Agency as an area having special flood hazards, or, if so located, the flood insurance required pursuant to Section 6.1(a)(i6.1(a) is in full force and effect with respect to such the applicable Individual Property.

Except To Borrower’s actual knowledge and except as disclosed in shown on the Surveys delivered to Lender or in the flood determination obtained by Lender prior to the Closing DateSurvey, none of the Improvements on any Individual the Property are located in an area as identified by the Federal Emergency Management Agency as an area having special flood hazards, hazards or, if so located, the flood insurance required pursuant to Section 6.1(a)(i) is in full force and effect with respect to such Individual the Property.

Except To the best of Borrower’s knowledge and except as otherwise disclosed in the Surveys delivered to Lender or in Title Insurance Policy and/or the flood determination obtained by Lender prior to the Closing DateSurvey, none of the Improvements on any Individual the Property are located in an area as identified by the Federal Emergency Management Agency as an area having special flood hazards, or, if so located, the flood insurance required pursuant to Section 6.1(a)(i) is in full force and effect with respect to such Individual the Property.

Except as disclosed in set forth on the Surveys delivered to Lender or in the flood determination obtained by Lender prior to the Closing DateSurvey, none of the Improvements on any Individual Property are located in an area as identified by the Federal Emergency Management Agency as an area having special flood hazards, or, if so locatedany portion of the Improvements is located within such area, Borrower has obtained the flood insurance required pursuant to prescribed in Section 6.1(a)(i) is in full force and effect with respect to such Individual Property8.1(a)(iv).

Except as disclosed set forth in the Surveys delivered to Lender any Property Condition Report or in the flood determination obtained by Lender prior survey with respect to the Closing DateProperty, none of the Improvements on any Individual the Property are located in an area as identified by the Federal Emergency Management Agency as an area having special flood hazards, or, if so locatedany portion of the Improvements is located within such area, Borrower has or has caused to be obtained the flood insurance prescribed in Section 8.1(a)(i) or comparable insurance as required to be supplied by a Tenant pursuant to Section 6.1(a)(i) is in full force and effect with respect to such Individual Propertytheir Lease.

Except To the best of Xxxxxxxx’s knowledge, except as disclosed in shown on the Surveys delivered to Lender or in the flood determination obtained by Lender prior to the Closing DateSurvey, none of the Improvements on the Property (or any Individual Property portion thereof) are located in an area as identified by the Federal Emergency Management Agency as an area having special flood hazards, or, if so located, the flood insurance required pursuant to Section 6.1(a)(i6.1(a) is in full force and effect with respect to such the applicable Individual Property.

Except as disclosed in the Surveys delivered to Lender or in the flood determination obtained by Lender prior to the Closing Dateset forth on any Survey, none of the Improvements on any Individual Property the Collective Properties are located in an area as identified by the Federal Emergency Management Agency as an area having a special flood hazardshazard area, or, if so located, located the flood insurance required pursuant to Section 6.1(a)(i5.1.1(a) hereof is in full force and effect with respect to such Individual Property.

Flood Zone. Except as disclosed may be set forth in the Surveys delivered to Lender or in the flood determination obtained by Lender prior Survey, to the Closing DateBorrower’s Knowledge, none of the Improvements on any Individual the Property are located in an area as identified by the Federal Emergency Management Agency as an area having a special flood hazardshazard area, or, if so located, located the flood insurance required pursuant to Section 6.1(a)(i5.1.1(a) hereof is in full force and effect with respect to such Individual the Property.

Except as disclosed in may be shown on the Surveys surveys delivered to Lender or in connection with the flood determination obtained by Lender prior to closing of the Closing DateLoan, none of the Improvements on the Property (or any Individual Property portion thereof) are located in an area as identified by the Federal Emergency Management Agency as an area having special flood hazards, or, if so located, the flood insurance required pursuant to Section 6.1(a)(i6.1(a) is in full force and effect with respect to such the applicable Individual Property.
