Common use of Flexibility Necessary Clause in Contracts

Flexibility Necessary. Implementation of the Project may require refinements to the Project by ▇▇▇▇▇▇▇▇▇’▇. Those refinements may demonstrate that clarifications to this Agreement and the Existing Land Use Regulations are appropriate. The Parties desire to retain a certain degree of flexibility with respect to those items covered in general terms under this Agreement. Therefore, Minor Modifications to the Project and/or this Agreement by ▇▇▇▇▇▇▇▇▇’▇ shall not require Amendment of this Agreement, nor shall they constitute discretionary actions within the meaning CEQA.
