Fixed Media Clause Samples
The Fixed Media clause defines the specific media formats or platforms on which certain content or works may be used or distributed. In practice, this clause limits the use of licensed material to predetermined formats such as print, CD, DVD, or other tangible media, excluding digital or online distribution unless otherwise specified. Its core function is to clearly delineate the scope of usage rights, preventing unauthorized exploitation of the content on unapproved media and thereby protecting the interests of the rights holder.
Fixed Media. Additionally, Licensor shall promptly replace at no cost to the Licensee all or part of the database which is defective or does not conform with this agreement, provided that the Licensee gives the Licensor written notice of the nonconformity, defect, or damage within sixty (60) days after Licensee’s receipt of the copy. Without such notice, Licensor shall make replacement at the Licensor’s replacement cost.
