First Supplemental Indenture Controls Clause Samples
The "First Supplemental Indenture Controls" clause establishes that the terms and provisions of the First Supplemental Indenture take precedence over any conflicting terms in the original indenture or other related documents. In practice, this means that if there is any inconsistency between the original agreement and the supplemental indenture, the supplemental terms will govern the parties' rights and obligations. This clause ensures clarity and legal certainty by resolving potential conflicts between documents, thereby preventing disputes over which terms apply.
First Supplemental Indenture Controls. To the extent that there is any conflict or inconsistency between the Original Indenture and this First Supplemental Indenture, the provisions of this First Supplemental Indenture shall control.
