Common use of First Lien Indebtedness Ratio Clause in Contracts

First Lien Indebtedness Ratio. The Borrower will not permit the First Lien Indebtedness Ratio on any date to be greater than (x) 3.75 to 1.00 at any time during the period beginning on Fifth Restatement Effective Date and ending on December 31, 2014 and (y) 3.50 to 1.00 thereafter.

First Lien Indebtedness Ratio. The Borrower will not permit the First Lien Indebtedness Ratio on any date to be greater than (x) 3.75 to 1.00 at any time during the ratio set forth below opposite the period beginning on Fifth during which such date falls: Period Ratio From the Fourth Restatement Effective Date through and ending on including December 30, 2010 3.50 to 1.00 From December 31, 2014 2010 through and (y) 3.50 including December 30, 2012 3.25 to 1.00 thereafterFrom December 31, 2012 and at all times thereafter 3.00 to 1.00.
