Political Body shall telephone the Railroad during normal business hours (7:00 a.m. to 9:00 p.m. Central Time, Monday through Friday, except holidays) at 0-000-000-0000 (also a 24-hour, 7-day number for emergency calls) to determine if fiber optic cable is buried anywhere on the Railroad's premises to be used by the Political Body. If it is, Political Body will telephone the telecommunications company(ies) involved, arrange for a cable locator, and make arrangements for relocation or other protection of the fiber optic cable prior to beginning any work on the Railroad's premises.
Fiber Optic Cables. The SFPUC understands that Licensee’s Equipment on the License Area will include fiber-optic cables. By entering into this Master License, Licensee grants to the City a license to use four strands of any fiber-optic cable that Licensee owns at each licensed SFPUC Pole. Licensee will designate and xxxx four strands of fiber in any conduit feeding the License Area for municipal use, effective upon installation of fiber-optic cable on each License Area. Licensee agrees that upon the expiration or termination of this Master License, Licensee will grant to the City by quitclaim or xxxx of sale title to any fiber strands owned by Licensee that the City uses or desires to use at no expense to Licensee..

The Line is expected to include fiber optic cable for, inter alia, protective relaying communications, operational data and real-time thermal rating (the “Related Fiber Optic Cable”). The Related Fiber Optic Cable and any other fiber optic cable (“Other Fiber Optic Cable”) located with the CL&P Line shall be owned and operated by CL&P and the Related Fiber Optic Cable and Other Fiber Optic Cable located with the UI Line shall be owned and operated by UI. Decisions and contractual arrangements concerning fiber optic cable shall be made by, and inure to the benefit of, the owner of the portion of the Line in which such fiber optic cable is placed.

By entering into this Master License, Xxxxxxxx agrees that if it proposes the installation of conduits in a License Area, then Licensee shall have an obligation to engage in good faith negotiations that would result in the installation of conduit for the exclusive use of the City for municipal use. Nothing in this agreement would require Licensee or the City to reach agreement on the terms of such installation.
