Common use of Fees Nonrefundable Clause in Contracts

Fees Nonrefundable. All fees set forth in this Section 3.4 and closing fees payable pursuant to Section 6.1(d) shall be paid on the date due, in immediately available funds, to the Agent for distribution, if and as appropriate, to the Banks and, once paid, none of such fees shall be refundable under any circumstances.
