February 2015. As part of this transaction I am to make a down payment of money to “Ohio Real Estate Auctions” who will then transfer that money to M & M Title Company. who will hold the money until closing. SAMPLE I understand that the funds I have provided to Ohio Real Estate Auctions/M & M Title Company. are to be used as part of the purchase price. However, in the event I do not close on this property, I irrevocably instruct M & M Title Company. to disburse my down payment as required under paragraph 2 of the contract; see below. Paragraph 2 states:
February 2015. [1] An application has been made for approval of an enterprise agreement known as the Launceston Church Grammar School (Teachers) Enterprise Agreement 1 March 2013 - 28 February 2015 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act) by Launceston Church Grammar School (the School). The agreement is a single-enterprise agreement. [2] On 25 January 2013 an undertaking was provided by the School’s Headmaster, Mr X Xxxxxx, in relation to clause 10 (Flexibility) of the Agreement. Pursuant to s.190 of the Act, I accept the undertaking of the School. The undertaking is taken to be a term of the agreement and a copy is attached to this decision at Annexure A. [3] In accordance with clause 14 (Consultation Regarding Major Workplace Change), the model consultation term is taken to be a term of the Agreement. [4] I am satisfied that each of the requirements of ss.186, 187 and 188 of the Act as is relevant to this application for approval has been met. [5] The Independent Education Union of Australia (Tasmanian Independent Schools Teachers Association Branch), being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) of the Act I note that the Agreement covers the organisation. [2013] FWCA 615 [6] The Agreement is approved and, in accordance with s.54 of the Act, will operate from 1 March 2013. The nominal expiry date of the Agreement is 28 February 2015.
