Common use of FCC FINAL ORDER Clause in Contracts

FCC FINAL ORDER. Seller or Purchaser may terminate this Agreement in the event that a Final Order of the FCC has not been received when, under the terms of the Escrow Agreement, any period of time applicable to the Escrowed Funds has expired thereby causing a return of the Escrowed Funds, by providing notice to such other party within 30 Business Days of such expiration. In the event a termination occurs pursuant to this Section 9.1(g): (i) Purchaser shall return the Shares to Seller; (ii) Seller shall return to Purchaser the AMSC Common Stock issued to Seller for the MAA Shares pursuant to the terms of Section 2.1(a); and (iii) each of the parties shall have only those rights and obligations held by such party prior to the Closing Date.
