FARMOUTOR'S CASING. POINT ELECTIONS When any Well Operations in any Farmout Well reach the objective thereof and if Farmoutee plans to install production casing in order to produce such well, AND ONLY IF Farmoutor has elected to participate in said Well Operation to reach said objective, Farmoutee shall notify Farmoutor thereof in writing and provide Farmoutor an estimate of the cost (AFE) to install production casing and complete the well for production. Within forty-eight (48) hours after receipt of such notice (inclusive of weekends and federal holidays), Farmoutor shall inform Farmoutee of Farmoutor's election to participate in the casing and planned completion or have its participating interest be subject to the nonconsent recovery provisions of the Operating Agreement except that, as between Farmoutor and Farmoutee, the nonconsent recovery provisions of the first but not the second paragraph of Article IX. E shall apply, and such nonconsent recovery provisions of the first paragraph of Article IX. E shall apply only to costs and expenses after casing point attributable to any Farmoutor participating interest non-consented at casing point.

  • PREVAILING WAGE RATES - PUBLIC WORKS AND BUILDING SERVICES CONTRACTS If any portion of work being Bid is subject to the prevailing wage rate provisions of the Labor Law, the following shall apply:

  • LOCATION WITHIN ENTERPRISE OR REINVESTMENT ZONE At the time of the Application Approval Date, the Land is within an area designated either as an enterprise zone, pursuant to Chapter 2303 of the TEXAS GOVERNMENT CODE, or a reinvestment zone, pursuant to Chapter 311 or 312 of the TEXAS TAX CODE. The legal description, and information concerning the designation, of such zone is attached to this Agreement as EXHIBIT 1 and is incorporated herein by reference for all purposes.

  • Early and Safe Return to Work The Hospital and the Union both recognize their obligations in facilitating the early and safe return to work of disabled employees.   • Are There Distribution Rules That Apply After Death Special rules apply in the case of the divorce or death of a beneficiary of a Xxxxxxxxx Education Savings Account. In particular, any balances to the credit of a beneficiary must, within 30 days of death, be either: (i) rolled over to another beneficiary’s Xxxxxxxxx Education Savings Account according to the requirements of Section (4) (in which case the distribution will not be subject to tax) or (ii) distributed to a death beneficiary or the beneficiary’s estate (in which case the distribution will be subject to tax).
