Common use of Falsity of Representation or Warranty Clause in Contracts

Falsity of Representation or Warranty. If any representation or warranty or other statement of fact contained in any of the Borrower Documents or in any writing, certificate, report or statement at any time furnished the Lender by or on behalf of the Borrower pursuant to or in connection with this Agreement shall have been false or misleading in any material respect or which shall omit a material fact, whether or not made with knowledge, at the time it was made.

If any representation or warranty or other statement of fact contained in any of the Borrower Documents or in any writing, certificate, report or statement at any time furnished the Lender by or on behalf of the Borrower pursuant to or in connection with this Agreement or the Revolving Credit Loans shall have been false or misleading in any material respect or which shall omit a material fact, whether or not made with knowledge, at the time it was made.
