Failure to Timely File. Borrower’s failure to timely file its periodic reports required pursuant to the Securities Exchange Act of 1934 (including such additional time as allowed under rule 12b-25) shall be a default hereunder and shall trigger an increase in the annual interest rate as setforth above.
