Common use of Failure by CONTRACTOR to Clause in Contracts

Failure by CONTRACTOR to. comply with any of the provisions, covenants, or conditions of this Contract shall be a material breach of this Contract. In such event, ADMINISTRATOR may, and in addition to immediate termination and any other DocuSign Envelope ID: 23B4657D-C98F-4EA3-A3C2-208A37E4A951 remedies available at law, in equity, or otherwise specified in this Contract: 19.1.1 Afford CONTRACTOR a time period within which to cure the breach, which period shall be established by ADMINISTRATOR; and/or 19.1.2 Discontinue reimbursement to CONTRACTOR for and during the period in which CONTRACTOR is in breach, which reimbursement shall not be entitled to later recovery; and/or 19.1.3 Offset against any monies billed by CONTRACTOR but yet unpaid by COUNTY those monies disallowed pursuant to Subparagraph 19.1.2 above.
