Common use of Facility Capacity Clause in Contracts

Facility Capacity. The Parties acknowledge and agree that housing Sender juveniles will not be available if/when the population of the portion(s) of the Facility in operation at the time of referral is at capacity. If the Facility is at or near capacity, Host will work with Sender to determine which juveniles under the supervision of Sender should be released in the event the need arises for additional detention of juveniles at the Facility.
