Facility and System Layout. See Exhibit 2, Attachment A. Seller may, at its sole discretion, modify the System layout and design as Seller deems necessary for purposes of permitting, procurement, construction and project implementation, provided that any modifications which change the Estimated System Energy Production by more than 10 percent shall require prior written approval by Purchaser. To the extent of modifications are made pursuant to this Section, the Parties shall amend this Agreement and Exhibits to reflect the final as-built design within 60 days of the Commercial Operation Date.
