Facilitating the Bid. 2.1. Access to information Each party agrees to provide the other party, on a timely basis, with information that may be reasonably required to assist in the preparation of the bidder’s statement and the target’s statement (as applicable). 2.2. Consultation regarding documents 2.2.1. The bidder will give the target a reasonable opportunity to review an advanced draft of the bidder's statement in respect of the bid, and will consult in good faith with the target with respect to any comments the target may have on the bidder's statement. 2.2.2. The target will give the bidder a reasonable opportunity to review an advanced draft of the target's statement in respect of the bid, and will consult in good faith with the bidder with respect to any comments the bidder may have on that the target's statement. 2.3. Early despatch of offers 2.3.1. For the purposes of item 6 in section 633(1) of the Corporations Act and subject to complying with clause 2.3.2, the target agrees that the offers under the bid may be sent to the holders of the target shares on the day on which the finalised bidder's statement is sent to the target or within 28 days after that day. 2.3.2. Clause 2.3.1 is subject to the bidder providing the target with a final draft of its bidder's statement for review not less than 5 business days before it is lodged with ASIC under item 2 of section 633(1) of the Corporations Act.
