Extension Projects. Either Member may develop and construct Extension Projects and may connect Extension Projects to the Project at the State Line Terminal in Loving County, Texas or the Midland Delivery Facility in Midland, Texas (each as set forth on Exhibit B) or an intermediate point on the Project approved by the Board; provided that (i) the crude to be delivered into the Project meets the specifications set forth in the applicable Tariff and (ii) the connection is completed pursuant to a connection agreement with the Company. Connection of any Extension Project to the Project shall be at the connecting Member’s sole cost and expense. The Members shall use commercially reasonable efforts to cause the Company to take necessary and appropriate steps to facilitate the connection of Extension Projects.
