Common use of Expert not an Arbitrator Clause in Contracts

Expert not an Arbitrator. The Expert shall be deemed not to be an arbitrator but shall give his determination as an expert and the provisions of the Arbitration & Conciliation Act, 1996 and rules framed thereunder shall not apply to such Expert or his determination or the procedure by which he reaches his determination.
