Common use of Existing Standards Clause in Contracts

Existing Standards. The City shall process, consider, and review all Later Approvals in accordance with (i) the Approvals, (ii) subject to Section 5.4, the San Francisco General Plan, the Municipal Code (including the Subdivision Code), and all other applicable City policies, rules and regulations, as each of the foregoing is in effect on the Effective Date (“Existing Standards”), as the same may be amended or updated in accordance with permitted New City Laws as set forth in Section 5.6, (iii) California and federal law, as applicable, and (iv) this Agreement (collectively, “Applicable Laws”). Notwithstanding the foregoing, Developer shall implement the BMR program consistent with the City’s Procedures Manual as published by the City pursuant to Section 415 of the Planning Code and as consistent with this Agreement.
