Common use of Existing Contamination Clause in Contracts

Existing Contamination. “Existing Contamination” means any and all pollution or contamination caused by any Hazardous Material that previously existed or exists in, or was released onto, the soil or groundwater at or beneath the Premises as of the date the Authority first delivered the Premises to Operator for Operator’s use and occupancy under this Agreement.

Existing Contamination. “Existing Contamination” means any and all pollution or contamination caused by any Hazardous Material that previously existed hazardous substances, pollutants, contaminants or exists inwastes, present or existing at, on, or was released onto, under (including within the soil or groundwater at or beneath the Premises Site) or originating from the Site as of the date Effective Date of this PPA, including, without limitation, that contamination identified in the Authority first delivered past Site assessment, the Premises to Operator for Operator’s use September 30, 2003 report and occupancy under this Agreementany other subsequent Site assessment.
