Exempt Waste. Biohazardous or Biomedical Waste, Hazardous Waste, Sludge, 189 automobiles, automobile parts, boats, boat parts, boat trailers, internal combustion engines, lead- 190 acid batteries, any matter or materials which are not acceptable for disposal at a Solid Waste 191 landfill as defined in the Act and those wastes under the control of the Nuclear Regulatory 192 Commission.

Exempt Waste. 37 29.01 The CONTRACTOR shall not be required to collect or dispose of Exempt Waste, 38 but may offer such services. All such Collection and disposal of Exempt Waste is not regulated 39 under this Agreement, but if provided by the CONTRACTOR shall be in strict compliance with 40 all federal, state and local laws and regulations.
Exempt Waste. 20 Biohazardous or biomedical waste which may cause disease or reasonably be 21 suspected of harboring pathogenic organisms including human and animal parts, 22 contaminated bandages, pathological specimens, hypodermic needles, sharps, 23 contaminated clothing and surgical gloves from the operation of medical clinics, hospitals, 24 and other facilities that process this waste; Hazardous Waste; the accumulated solids, 25 residues, and precipitates generated as a result of waste treatment or processing, 26 including wastewater treatment, water supply treatment, or operation of an air pollution 27 control facility, and mixed liquids and solids pumped from septic tanks, grease traps, 28 privies, or similar disposal appurtenances or any other such waste having similar 29 characteristics or effects (biosolid); stable matter; Yard Trimmings or lumber that is more 30 than five (5) feet in length in its longest dimension or more than two (2) feet in diameter, 31 automobiles, automobile parts, boats, boat parts, boat trailers, internal combustion 32 engines, lead-acid batteries, and those wastes under the control of the Nuclear Regulatory 33 Commission, but not including those materials defined as Large Item and Recyclable 34 Material.

Exempt Waste. ‌ A. Under no circumstances shall the CONTRACTOR’s employees knowingly Collect Exempt Waste or remove unsafe or poorly containerized Exempt Waste from a Collection Container. If the CONTRACTOR determines that material placed in any Container for Collection is Exempt Waste, or other material that may not legally be accepted at the Materials Recovery Facility, Transfer Station, Organic Material Processing Facility or Disposal Facility, or presents a hazard to the CONTRACTOR’s employees, the CONTRACTOR shall have the right to refuse to accept such material. The Generator shall be contacted by the CONTRACTOR and requested to arrange for proper disposal service. If the Generator cannot be reached immediately, the CONTRACTOR shall, before leaving the premises, leave a Non-Collection Notice which indicates the reason for refusing to Collect the material and how the Exempt Waste can be properly disposed or recycled.

Exempt Waste. The CONTRACTOR acknowledges that it is responsible for compliance during the entire Term of this Agreement with all Applicable Laws. The CONTRACTOR shall not store, transport, use, or Dispose of any Exempt Waste except in strict compliance with all Applicable Laws. In the event that the CONTRACTOR negligently or willfully mishandles Exempt Waste in the course of carrying out its activities under this Agreement, the CONTACTOR shall at its sole expense promptly take all investigatory and/or remedial action reasonably required for the remediation of such environmental contamination. Prior to undertaking any investigatory or remedial action, however, the CONTACTOR shall first obtain the Contract Administrator’s approval of any proposed investigatory or remedial action. Should CONTRACTOR fail at any time to promptly take such action, the CITY may undertake such action at the CONTRACTOR’s sole cost and expense, and the CONTRACTOR shall reimburse the CITY for all such expenses within thirty (30) calendar days of being billed for those expenses, and any amount not paid within that thirty (30) calendar day period shall thereafter be deemed delinquent and subject to the delinquent fee payment provision of this Agreement. These obligations are in addition to any defense and indemnity obligations that the CONTRACTOR may have under this Agreement. The provisions of this Article shall survive the termination or expiration of this Agreement. Notwithstanding the foregoing, the CONTACTOR’s duties under this subsection shall not extend to any claims arising from the Disposal of Solid Waste at the Approved Disposal Facility, including, but not limited to, claims arising under Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) unless such claim is a direct result of the CONTACTOR’s negligence or willful misconduct or CONTRACTOR owns or operates the Approved Disposal Facility.
