Exempt Project Emissions. The MPO (or MDOT, for nonattainment or maintenance areas not included in an MPO) is the lead agency for evaluating whether projects otherwise exempted from meeting the requirements of 40 CFR 93.126 Exempt Projects and 93.127 Projects Exempt from Regional Emissions Analysis, should be treated as non-exempt in cases where potential adverse emissions impacts may exist for any reason.
