Common use of Executory Agreements Clause in Contracts

Executory Agreements. Liabilities and obligations which exist at or accrue following the Closing Date under (i) the Contracts described in Exhibit "4.24" hereof (including liabilities under various operating equipment leases); (ii) executory contracts, agreements or other commitments entered into in the ordinary course of business in existence on the date hereof and not required to be disclosed pursuant to Exhibit "4.24"; and (iii) executory contracts, agreements or other commitments entered into in the ordinary course of business between the date hereof and the Closing, in accordance with Section 6.2 hereof.

Executory Agreements. Liabilities and obligations which exist at or accrue following the Closing Date under (i) the Contracts described in attached Exhibit "4.24" hereof (including liabilities under various operating equipment leases)5.10; (ii) executory contracts, agreements or other commitments entered into in the ordinary course of business in existence of Seller and existing on the date hereof and not required to be disclosed pursuant to Exhibit "4.24"5.10; and (iii) executory contracts, agreements or other commitments entered into in the ordinary course of business between the date hereof and the Closing, in accordance with Section 6.2 hereof7.1 below.
