Exceptional cases (e g. LTD recommended employees who do not transition to LTD, employees who have returned to active employments from a medical absence who have not had their LTD recommendations lifted, employees whose LTD applications have been declined) will be referred to the JWC for further discussion. This referral does not preclude further settlement efforts at the local level. Local settlements will be sent to the JWC for review. In the event that the parties are unable to reach agreement, either party may refer the matter to expedited arbitration.
