Exceeding State Cap Clause Samples
The "Exceeding State Cap" clause sets a limit on the maximum amount of liability or payment that can be incurred under a contract, as determined by state law or regulation. In practice, this clause ensures that if the total obligations or claims surpass the statutory cap established by the relevant state, the party's responsibility is limited to that cap, regardless of the actual damages or costs. This provision is essential for managing financial risk and ensuring compliance with state-imposed limits, thereby protecting parties from unforeseen or excessive liabilities.
