Common use of Exact Names Clause in Contracts

Exact Names. The Grantor’s name in which it has executed this Agreement is the exact name as it appears in the Grantor’s organizational documents, as amended, as filed with the Grantor’s jurisdiction of organization, except to the extent that any of the foregoing has been changed in accordance with Section 4.6. Except as has been disclosed in any public filing of the Grantor or to the Holder, in such capacity or as the holder of equity interests in the Grantor, the Grantor has not, during the past five years, been known by or used any other corporate or fictitious name, or been a party to any merger or consolidation, or been a party to any acquisition.

Exact Names. The Such Grantor’s name in which it has executed this Security Agreement is the exact name as it appears in the such Grantor’s organizational documents, as amended, as filed with the such Grantor’s jurisdiction of organization, except to the extent that any of the foregoing has been changed in accordance with Section 4.64.13. Except as has been disclosed may be described in any public filing of an applicable Assumption Agreement executed after the Grantor or to the HolderEffective Date, in such capacity or as the holder of equity interests in the Grantor, the Grantor has not, during the past five yearsyears prior to the Effective Date (or in the five years immediately preceding the date of such Assumption Agreement), been known by or used any other corporate or fictitious name, or been a party to any merger or consolidation, or been a party to any acquisition.
