Common use of Events Giving Rise To Mediation or Arbitration Clause in Contracts

Events Giving Rise To Mediation or Arbitration. In the event that there is a dispute between the Managers or the Members as to any action or issue, or in the event of a deadlock between the Members, then and in such event all of the Members agree, upon the written request of any one Member, to submit to mediation within ten (10) days of receipt of the request for mediation for the purpose of resolving the dispute. If mediation is not successful in resolving the dispute; one or more of the Members may elect to have the dispute submitted to binding arbitration as provided in this Article 10 by giving written notice to each of the Members of such Member’s election to require arbitration of such dispute.
