Evaluation Product. Version of a Product and/or License designated as a demo, trial, free or beta version.

Evaluation Product. Licensee acknowledges and agrees that the Licensed Product is an evaluation product, and that the final production version of Company’s product may have different features, functionality, compatibility or may otherwise differ from the Licensed Product. Prior to disposing of any media or apparatus containing any part of the Licensed Product, Licensee shall completely destroy such part of the Licensed Product contained therein. Further, any Licensed Product specifically licensed for evaluation purposes, without charge or for a nominal charge, shall be deemed a free evaluation license and may be used for purposes of evaluation for a paid license only, and not for any productive use.
Evaluation Product. During the term of this Agreement and as agreed to by Vendor, BTE may acquire Product on a temporary basis for purposes of evaluation (“Evaluation Product”) for a period of time to be agreed to by the parties (“Evaluation Period”). BTE shall acquire such Evaluation Product under the terms and conditions as set forth in Exhibit 2.5, Evaluation Agreement. BTE may separately acquire Maintenance and Support Services upon mutually agreeable terms and conditions.
Evaluation Product. If the order is for End User to evaluate Product and its related Documentation on a temporary basis for non-commercial use in a non-production environment (“Evaluation Product”) and Imperva agrees to such evaluation, conditioned on End User’s compliance with the terms and conditions of this Agreement, Imperva grants to End User during the Evaluation Period (as defined below), a cost-free, nonsublicensable, nontransferable, nonassignable and nonexclusive, revocable license to use the Evaluation Product, solely at the location identified in writing by End User and solely for End User’s internal evaluation of the Evaluation Product. End User may only grant access to the Evaluation Product to employees, contractors, agents or consultants who are bound to confidentiality and non-use obligations no less protective of Imperva’s proprietary rights than this Agreement. Notwithstanding anything to the contrary as stated in this Agreement, all worldwide right, title and interest to the Evaluation Product, and all intellectual property rights in and to them, are and will remain the exclusive property of Imperva.
Evaluation Product. If the order is for End User to evaluate Product and its related Documentation on a temporary basis for non-commercial use ("Evaluation Product") and Imperva agrees to such evaluation, conditioned on End User's compliance with the terms and conditions of this Agreement, the license set forth in Section 2(a) shall not apply and Imperva grants to End User during the Evaluation Period (as defined below), a cost-free, nonsublicensable, nontransferable, nonassignable and nonexclusive, revocable license to use the Evaluation Product, solely at the location identified in writing by End User and solely for End User's internal evaluation of the Evaluation Product.
Evaluation Product. Illumina will prepare and deliver the Evaluation Product to the Facility identified above (“Delivery”). For Evaluation Products which require installation by Illumina, Illumina will support such installation at that Facility on a mutually convenient date. Any Delivery or installation date or time provided by Illumina is an estimate only and time will not be of the essence for Delivery or installation. Evaluation Site will provide to Illumina all of the necessary technical information, network and computer facilities and access to premises and personnel as Illumina may reasonably require to effect Delivery and installation.
Evaluation Product. Illumina owns and retains all right, title, and interest in and to the Evaluation Product. The transfer of the Evaluation Product by Illumina to Evaluation Site will not constitute a sale or offer for sale of the Evaluation Product, in whole or in part, or an option or license in or to any such Evaluation Product or any information or intellectual property relating thereto. Further, Illumina makes no guarantee that any Evaluation Product will be made commercially available at a later date.

Evaluation Product. If the Services are provided to Client under an evaluation grant (the “Evaluation Product”), the client may use the Evaluation Product solely for the purpose of evaluating the suitability of the Evaluation Product for licensing on a for fee basis or demonstrating the Evaluation Product internally within the Client’s organization, as applicable. The Evaluation Product is provided “as is” without indemnification, support or warranty of any kind, whether express, implied, statutory or otherwise. Notwithstanding anything to the contrary herein, Company has no duty to provide support for the Evaluation Product, and COMPANY BEARS NO LIABILITY FOR ANY DAMAGES RESULTING FROM USE OF THE EVALUATION PRODUCT. This warranty applies only to the Evaluation Product and does not extend to the life of the Services once it is no longer in this Evaluation period. Client acknowledges that its rights in and to the Evaluation Product are solely the right to evaluate and assess the Services pursuant to this Agreement and does not include any rights of ownership in any of the Services. All provisions of this Agreement apply to the Evaluation Product except as otherwise specified in this Section 2.
Evaluation Product. 7.1 For Product that is clearly marked ‘Evaluation’, you may copy, install and use the Product on any number of PCs, without charge for evaluation purposes only, for a period up to 45 days.
