Common use of EU-U.S. Privacy Shield Framework Clause in Contracts

EU-U.S. Privacy Shield Framework. Qstream complies with the EU-US and Swiss-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland. Qstream agrees to only process Personal Data (as defined in the EU-US and Swiss-US Privacy Shield Framework) on behalf of and in accordance with Customer’s instructions and shall treat such Personal Data as Confidential Information. Customer hereby instructs Qstream to process Personal Data for the following purposes: (i) in accordance with the Agreement and applicable Order Form(s); (ii) initiated by Users in their use of the Services; and (iii) to comply with other reasonable instructions provided by Customer (e.g., via email) where such instructions are consistent with the terms of the Agreement.
