Common use of Ethernet Service Clause in Contracts

Ethernet Service. For Fast Ethernet Access Customer shall pay a range of monthly recurring charges from $275. to $1,105. for speeds ranging from 1MB to 7 MB. No installation charges apply to Fast Ethernet Access. For Converged Ethernet Access Customer shall pay a range of monthly recurring charges from $688.30 to $4,548.69 for speeds ranging from 15MB to 1,000 MB at 51 mutually agreed upon locations by Customer and Company. For Type 1 and secondary CFA access, Customer will pay a range of monthly recurring charges from $688.30 to $4,548.69 at speeds ranging from 15MB to 1000 MB. For Type 3 access, Customer shall pay a range of monthly recurring charges from $685 to $1,105 at speeds of 4MB to $1,105 Customer will pay a monthly recurring charge of $6,000 for backhaul charges to connect Customer premises to Company CPA switch with OC3 service with mileage of 767. Private Line: Private Line - Global Data Link Service (Option 1). Private Line – Global Data Link services provided pursuant to the agreement are governed by the Guide provisions relating to International Private Line Full Circuit and applicable Tariffs. US Private Line Services –Interstate and Intrastate (Option 1 and 2). Customer will pay the following range of fix per circuit inter-office channel (“IOC”) charge and the monthly recurring per mile minimum IOC . Customer shall pay a range of $475 to $750 fixed charge for DS), Fractional DS1 and DS1 mileage. Customer will pay a monthly recurring charge of $0.30 to $0.85 per mile. Dedicated Leased Line/ US Private Line Interstate Services. Customer will pay the following fixed and per mile IOC charges based on circuit types as follows: For OC3 (Linear and Restorable) Customer will pay a per mile charge of $14.00 and circuit minimum of $2,000 per month is required. For OC12 (Linear and Restorable) Customer will pay a per mile charge of $18.00 and circuit minimum of $5,000 per month is required. Customer certifies that at least 10% of any Private Line circuit will carry interstate traffic. Customer will pay the following monthly recurring charges which are fixed for the Term of the agreement, for each Port and Permanent Virtual Circuit (“PVC”) as follows: For Port monthly recurring charges, Customer will pay a range of charges from $163 to $4,680 depending upon speed. For PVC monthly recurring charges, Customer will pay a range of charges from $12 to $8,439. For Simplex PVC monthly recurring charges (usage based), Customer will pay a range of charges from $5 - $20 (Min.) to $28.97 to $66,745.88 (max.) Data: The Customer will receive the following discounts for Data Services: Customer will receive a discount of 67% off the domestic Frame Relay port and PVC monthly recurring charges (fixed and usage) listed above. Customer will receive a seventy-nine percent (79%) discount on the above Fractional DS1 mileage fixed charges and monthly recurring charges.
