ERRATA. The Parties acknowledge that the Purchase Agreement and Exhibits thereto, including the Purchase Note, the Intercreditor and Subordination Agreement with the Senior Lender and the share certificate representing the Holdings Purchase Shares (collectively, the “Purchase Documents”) all referred to Eggluftstein as the “Eggluftstein Trust” when it should have been designated as the “Eggluftstein Sub Trust.” Accordingly, all Parties hereto do hereby agree that all references in this Agrteement and in all of Purchase Documents to “Eggluftstein” or “Eggluftstein Trust” shall be and is hereby amended to mean the “Eggluftstein Sub Trust.”

ERRATA. (a) Section 1.3 of the Lease is hereby amended by adding to the words "day after the" after the words "from the" appearing in the tenth line of Section 1.3 of the Lease.
ERRATA. A question has arisen concerning the Assistant Administrator’s authority to adjust the catch limitations set forth in Appendix B to Part 651 within the limits prescribed in the FMP. The regulation implementing the FMP empowers the Assistant Administrator to adjust the catch limitations and overrun allowances downward only, to insure that closures are prevented. The Council believes § 651.23(f) of the regulations is not consistent with its intent to provide the Assistant Administrator with latitude to “adjust” these limitations within the maximum and minimum limits prescribed in the FMP. The Council intended the Assistant Administrator to have authority to adjust the limitations in Appendix B up or down, consistent with the vessel classes’ quarterly allocations, in order to achieve an optimum yield from the fishery. Accordingly, § 651.23(f) is corrected to reflect this intent.
ERRATA. In Section 4.2 of each of the Deed of Trust and the deed of trust made by Associates securing Associates' repayment guaranty, "7.11" is hereby deleted and replaced with "7.12". In addition, the following is hereby added to the end of Section 11.1(b) of the Original Loan Agreement: "; or a default by Borrower (following any applicable notice and cure period) under any of the Other Related Documents".
