Equipment and Methods. The work under this contract shall be prosecuted with all materials, tools, machinery, apparatus, and labor and by such methods as are necessary to complete execution of everything described, shown, or reasonably implied under this contract. The Contractor shall give District Engineer full information in advance as to Contractor’s plans for carrying out any part of the work. If at any time before the beginning or during the progress of the work, any part of Contractor's plant, or equipment or any of Contractor’s methods of execution of the work, appear to District Engineer to be unsafe, inefficient, or inadequate to insure the required quality or rate of progress of the work, District Engineer may order Contractor to increase or improve Contractor’s facilities or methods, and Contractor shall comply promptly with such orders; but neither compliance with such orders or failure of District Engineer to issue such orders shall relieve Contractor from Contractor’s obligation to secure the degree of safety, the quality of the work, and the rate of progress required of Contractor. The Contractor alone shall be responsible for the safety, adequacy, and efficiency of its plant, equipment and methods.

  • Equipment and Materials Contractor at its sole cost and expense shall provide and furnish all tools, labor, materials, equipment, transportation services and any other items (collectively, "Equipment") which are required or necessary to perform the Services in a manner which is consistent with generally accepted standards of the profession for similar services. Notwithstanding the foregoing, District shall not be responsible for any damages to persons or property as a result of the use, misuse or failure of any Equipment used by Contractor of the Contracted Parties, even if such Equipment is furnished, rented or loaned to Contractor or the Contracted Parties by District. Furthermore, any Equipment or workmanship that does not conform to the regulations of this Agreement may be rejected by District and in such case must be promptly remedied or replaced by Contractor at no additional cost to District and subject to District’s reasonable satisfaction.

  • EQUIPMENT AND TOOLS 40.01 The Employer will make available all necessary tools and equipment it requires for the performance of work assignments at no cost to the employees.
