Common use of Equality Clause in Contracts

Equality. All Shares of each particular Series shall represent an equal proportionate interest in the assets belonging to that Series (subject to the liabilities belonging to that Series), and each Share of any particular Series shall be equal to each other Share of that Series; but the provisions of this sentence shall not restrict any distinctions permissible under subsection (c) of this Section 4.2 that may exist with respect to dividends and distributions on Shares of the same Series. The Trustees may from time to time divide or combine the Shares of any particular Series into a greater or lesser number of Shares of that Series without thereby changing the proportionate beneficial interest in the assets belonging to that Series or in any way affecting the rights of Shares of any other Series.

The Trustees may from time to time divide or combine the Shares of any particular Class or Series into a greater or lesser number of Shares of that Class or Series without thereby changing the proportionate beneficial interest in the assets belonging to that Class or Series or in any way affecting the rights of Shares of any other SeriesClass or Series and Shares of each Class of a Series shall be equal to each other Share of such Class.

The Trustees may from time to time divide or combine the Shares Units of any particular Series into a greater or lesser number of Shares Units of that Series without thereby changing the proportionate beneficial interest in the assets belonging to that Series or in any way affecting the rights of Shares Units of any other Series.

Equality. All Shares of each particular Series shall represent an equal proportionate interest in the assets belonging to that Series Portfolio (subject to the liabilities belonging to of that SeriesPortfolio), and each Share of any particular Series shall be equal to each other Share of that Series; thereof, but the provisions of this sentence shall not restrict any distinctions permissible under subsection (c) of this Section 4.2 6.2 that may exist with respect to dividends and distributions on Shares of the same Series. The Trustees may from time to time divide or combine the Shares of any particular Series into a greater or lesser number of Shares of that Series without thereby changing the proportionate beneficial interest in the assets belonging to that Series Portfolio or in any way affecting the rights of the holders of Shares of any other Series.
