The Equal Class clause ensures that all parties or entities within a specified group are treated uniformly under the terms of the agreement. In practice, this means that no individual or subgroup receives preferential treatment or is subject to different obligations or benefits compared to others in the same class. For example, in a shareholder agreement, this clause would require that all shares of the same class have identical rights and privileges. The core function of the Equal Class clause is to promote fairness and consistency, preventing discrimination or unequal treatment among similarly situated parties.
