Common use of Environmental Reports Clause in Contracts

Environmental Reports. Furnish Agent, concurrently with the delivery of the financial statements referred to in Sections 9.7 and 9.8, with a certificate signed by the President of Borrowing Agent stating, to the best of his knowledge, that each Borrower is in compliance in all material respects with all federal, state and local Environmental Laws. To the extent any Borrower is not in compliance with the foregoing laws, the certificate shall set forth with specificity all areas of non-compliance and the proposed action such Borrower will implement in order to achieve full compliance.

Environmental Reports. Furnish Agent, concurrently with the delivery of the financial statements referred to in Sections 9.7 and 9.8, with a certificate signed by the President of Borrowing Agent each Borrower stating, to the best of his knowledge, that each Borrower is in compliance in all material respects with all federal, state and local Environmental Lawslaws relating to environmental protection and control and occupational safety and health. Furnish Agent, concurrently with the delivery of the financial statements referred to in Sections 9.7 and 9.8, with a certificate signed by the President, Vice President or other authorized officer of Borrowing Agent each Borrower stating, to the best of his knowledge, that each Borrower is in compliance in all material respects with all federal, state and local Environmental Lawslaws relating to environmental protection and control and occupational safety and health, the failure of which to comply would result in a Material Adverse Effect. To the extent any Borrower is does not in compliance with the foregoing lawsprovide such certification, the certificate shall set forth with specificity all the areas of non-compliance and the proposed action such Borrower will implement in order to achieve full compliance.

Furnish Agent, concurrently with the delivery of the financial statements referred to in Sections 9.7 and 9.8, with a certificate Compliance Certificate signed by the President an Authorized Officer of Borrowing Agent stating, to the best of his knowledge, that each Borrower is the Credit Parties are in compliance in all material respects with all federal, state and local Environmental Laws. To the extent any Borrower Credit Party is not in compliance with the foregoing laws, the certificate shall set forth with specificity all areas of non-compliance and the proposed action such Borrower Borrowers’ will implement in order to achieve full compliance.

Furnish Upon request of Agent, furnish Agent, concurrently with the delivery of the financial statements referred to in Sections 9.7 and 9.8, with a certificate Compliance Certificate signed by the President or Chief Executive Officer of Borrowing Agent Borrower stating, to the best of his knowledge, that each Borrower is in compliance in all material respects with all federal, state and local Environmental Laws. To the extent any Borrower is not in compliance with the foregoing laws, the certificate shall set forth with specificity all areas of non-compliance and the proposed action such Borrower will implement in order to achieve full compliance.

To the extent any Borrower is not in compliance with the foregoing laws, the certificate shall set forth with specificity all areas of non-compliance and the proposed action such Borrower will implement in order to achieve full compliance.

To or to the extent any Borrower is not in compliance in all material respects with the foregoing lawsSections, the certificate shall set forth with specificity all areas of non-compliance and the proposed action such Borrower will implement in order to achieve full compliance.

To the extent any such Borrower is not in compliance with the foregoing laws, the certificate shall set forth with specificity all areas of non-compliance and the proposed action such Borrower will implement in order to achieve full compliance.

To the extent any Borrower is not in compliance with the foregoing laws, the certificate shall set forth with specificity all areas of material non-compliance and the proposed action such Borrower will implement in order to achieve full compliance.
