Common use of Environmental Questionnaire Clause in Contracts

Environmental Questionnaire. Prior to executing this Lease, Tenant has completed and delivered to Landlord Tenant’s initial hazardous materials disclosure (the “Initial Hazardous Substances Disclosure”), the form of which is attached here to as Exhibit E. Tenant covenants, represents and warrants to Landlord that, to the knowledge of Tenant after commercially reasonable inquiry, the information in the Initial Hazardous Substances Disclosure is true and correct and accurately describes the use(s) of Hazardous Substances that may be stored and/or used on the Leased Premises by Tenant. Following Landlord’s written request (which shall be limited to no more than one (1) time per calendar year), Tenant shall complete and deliver to Landlord a Hazardous Substances Disclosure (the “Hazardous Substances Disclosure”) describing Tenant’s then present storage and/or use of Hazardous Substances at the Leased Premises.
