Common use of Environmental Liens Clause in Contracts

Environmental Liens. In the event that there shall be filed a lien against any property of the Borrower by any jurisdiction, political subdivision, agency, or instrumentality thereof, arising from an intentional or unintentional act or omission of the Borrower, resulting in the discharging of hazardous substance or wastes into the atmosphere or waters, or onto lands, then, within thirty (30) days from the date that the Borrower is given notice that the lien has been placed against such property, or within such shorter period of time in the event that such jurisdiction, political subdivision, agency or instrumentality thereof has commenced steps to cause such property to be sold pursuant to the lien, the Borrower shall either (i) pay the claim and remove the lien from the applicable property or (ii) furnish to such jurisdiction, political subdivision, agency; or instrumentality thereof that imposed the lien one of the following: (a) a bond satisfactory to such jurisdiction, political subdivision, agency, or instrumentality thereof in the amount of the claim out of which the lien arises, (b) a cash deposit in the amount of the claim out of which the lien arises; or (c) other security reasonably satisfactory to such jurisdiction, political subdivision, agency or instrumentality thereof in an amount sufficient to discharge the claim out of which the lien arises;
