Environmental Damage. (a) Contractor shall be liable for those direct losses or damages incurred by a Third Party (other than the Government) arising out of any environmental pollution determined by the appropriate court of the Azerbaijan Republic to have been caused by the fault of Contractor. In the event of any environmental pollution or environmental damage caused by the fault of Contractor, Contractor shall reasonably endeavour, in accordance with generally acceptable international Petroleum industry practices, to mitigate the effect of any such pollution or damage on the environment.
Environmental Damage. Environmental damage means injury to, damage sustained by or destruction or loss of land, air, water, groundwater, drinking water supplies and fish, wildlife, biota and their habitats for which the named insured is liable under environmental law. Environmental damage does not include property damage.
Environmental Damage insured section F Environmental damage means harm or injury to, damage sustained by or the destruction of land, water, protected species and or natural habitats for which the insured is legally liable under European Union Directive 2004/35/EC on environmental liability or any local legislation in a Member State which implements it. For the avoidance of doubt environmental damage includes primary remediation, complementary remediation and compensatory remediation.

Environmental Damage. The Borrower will, forthwith upon acquiring knowledge thereof, notify the Agent of the discovery of any Contaminant or of any Release of a Contaminant into the Environment from or upon the land or property owned (either individually or jointly), operated or controlled by any Borrower Group Member which would reasonably be expected to have a Material Adverse Effect.
Environmental Damage. 9.1 The NWMO will be solely responsible for any environmental damage or adverse effects to the Borehole Drilling Site and any environmental clean-up or rehabilitation that may be required as a specified in Appendix B. The NWMO is not responsible for:
Environmental Damage. Grantee shall indemnify, defend, and hold harmless Grantor from and against any and all claims, damage, liability, cost, penalty, fine or expense, including Grantor’s reasonable attorney’s fees, for any environmental damages arising from the presence or use of hazardous materials caused, permitted or suffered by Xxxxxxx’s use of the Easement or arising in any manner whatsoever out of the violation of any environmental requirements, whether local, state or federal, pertaining to Grantee’s activities on the Easement (“Environmental Damage(s)”). Grantee shall be responsible for, and control all aspects of, any clean-up, disposal or compliance for any and all Environmental Damages required by local, state and/or federal law caused by Grantee. Grantee shall be responsible for the hiring, management of, and costs associated with, (i) any third-party inspection of the site by an engineer, environmental consultant, surveyors, etc.; and (ii) any third-party remediation company, if applicable, as required by federal, state or local authorities as a result of possible Environmental Damages. Any such clean-up shall be performed in accordance with federal, state or local generally accepted standards, as applicable, regarding the sufficiency of the clean-up and whether such clean-up complies with local, state and/or federal law.
