Common use of Environmental Consultants Clause in Contracts

Environmental Consultants. None of the environmental consultants which prepared environmental and asbestos inspection reports with respect to certain of the Properties was employed for such purpose on a contingent basis or has any substantial interest in the Company, the Operating Partnership or any Subsidiary and none of them nor any of their directors, officers or employees is connected with the Company, the Operating Partnership or any Subsidiary as a promoter, selling agent, voting trustee, director, officer or employee.

Environmental Consultants. None of the environmental consultants which prepared environmental and asbestos inspection reports with respect to certain of the Properties was employed for such purpose on a contingent basis or has any substantial interest in the Company, the Operating Partnership or any Subsidiary and none of them nor any of their directors, officers or employees is connected with the Company, the Operating Partnership or any Subsidiary as a promoter, selling agent, voting trustee, director, officer or employee.

None of the environmental consultants which prepared environmental and asbestos inspection reports with respect to certain of the Portfolio Properties was employed for such purpose on a contingent basis or has any substantial interest in the Company, the Operating Partnership any Simon Entity or any Subsidiary Property Partnership and none of them nor any of their directors, officers or employees is connected with the Company, the Operating Partnership any Simon Entity or any Subsidiary Property Partnership as a promoter, selling agent, voting trustee, director, officer or employee.

None of the environmental consultants which prepared environmental and asbestos inspection reports with respect to certain of the Properties was employed for such purpose on a contingent basis or has any substantial interest in the Company, the Operating Partnership or any Subsidiary and none of them nor or any of their directors, officers or employees is connected with the Company, the Operating Partnership or any Subsidiary as a promoter, selling agent, voting trustee, director, officer or employee.

None of the environmental consultants which that prepared any of the environmental and asbestos inspection reports with respect to certain any of the Properties was employed for such purpose on a contingent basis or has any substantial interest in the CompanyARC, the Operating Partnership Company or any Subsidiary of their respective Subsidiaries, and none of them nor nor, to the best knowledge of ARC, the Company or any of their respective Subsidiaries, any of their directors, officers or employees is connected with the CompanyARC, the Operating Partnership Company or any Subsidiary of their respective Subsidiaries as a promoter, selling agent, voting trustee, director, officer or employee.

None of the environmental consultants which prepared environmental and asbestos inspection reports with respect to certain of the SDG Properties was employed for such purpose on a contingent basis or has any substantial interest in the Company, the Operating Partnership any Simox XxXxxxxxx Xxxity or any Subsidiary Property Partnership and none of them nor any of their directors, officers or employees is connected with the Company, the Operating Partnership any Simox XxXxxxxxx Xxxity or any Subsidiary Property Partnership as a promoter, selling agent, voting trustee, director, officer or employee.
