ENGINEER’S FEE. 6.2.1 The Engineer’s fee shall be a fixed fee paid pursuant to the provisions of Article 6, subparagraph 6.2.3, and 6.5 Additional Services, subparagraph 6.5.2

ENGINEER’S FEE. If the Engineer for the ▇▇▇▇▇▇▇ Improvements is the same as the Engineer for the CID Improvements and the other infrastructure improvements on the Project Site, then Developer, as the City's design and construction manager, shall cause the Engineer's fee for preparation of the Engineering Plans and the Engineer's fee for construction of the ▇▇▇▇▇▇▇ Improvements to be clearly differentiated from other CID Improvements and the other improvements to the Project Site. The Engineer's fee estimate shall include a detailed breakdown of direct labor hours, hourly rates, overhead, and proposed profit for all major project elements of the ▇▇▇▇▇▇▇ Improvements.

ENGINEER’S FEE. A. Basic Fee 1) As compensation for Basic Services as described in Exhibit 1 of this Agreement, and for services required in the fulfillment of Paragraph 1, the Engineer shall be paid on an hourly rate based upon the "Schedule of Rates" in Exhibit 2 of this agreement, which shall constitute full and complete payment for said services and all expenditures which may be made and expenses incurred, except as otherwise expressly provided in this Agreement. Terms and Conditions for Consulting Services 1. STANDARD OF PERFORMANCE The standard of care for all professional engineering, consulting and related services performed or furnished by CONSULTANT and its employees under this Agreement will be the care and skill ordinarily used by members of CONSULTANT’s profession practicing under the same or similar circumstances at the same time and in the same locality. CONSULTANT makes no warranties, express or implied, under this Agreement or otherwise, in connection with CONSULTANT’s services. 2. INSURANCE/INDEMNITY CONSULTANT agrees to procure and maintain, at its expense, Workers' Compensation insurance as required by statute; Employer's Liability of $250,000; Automobile Liability insurance of $1,000,000 combined single limit for bodily injury and property damage covering all vehicles, including hired vehicles, owned and non-owned vehicles; Commercial General Liability insurance of $1,000,000 combined single limit for personal injury and property damage; and Professional Liability insurance of $1,000,000 per claim for protection against claims arising out of the performance of services under this Agreement caused by negligent acts, errors, or omissions for which CONSULTANT is legally liable. OWNER shall be made an additional insured on Commercial General and Automobile Liability insurance policies and certificates of insurance will be furnished to the OWNER. CONSULTANT agrees to indemnify OWNER for third party personal injury and property damage claims to the extent caused by CONSULTANT's negligent acts, errors or omissions. However, neither Party to this Agreement shall be liable to the other Party for any special, incidental, indirect, or consequential damages (including but not limited to loss of use or opportunity; loss of good will; cost of substitute facilities, goods, or services; cost of capital; and/or fines or penalties), loss of profits or revenue arising out of, resulting from, or in any way related to the Project or the Agreement from any cause or causes, including but not limited to any such damages caused by the negligence, errors or omissions, strict liability or breach of contract.

ENGINEER’S FEE. HDR will perform the above scope of work for Task Order 6 for an hourly not to exceed fee of $86,623.00.

ENGINEER’S FEE. Total estimated fee is $8,000. This is a time and materials (T&M) budget estimate, based on the above scope items and attached 2020 hourly labor rate sheet. Should an increased level-of-effort be required, HDR will inform the City and obtain authorization to modify the above-noted budget.
