Common use of Enforcement of Rights Clause in Contracts

Enforcement of Rights. Notwithstanding any of the provisions of this Agreement, any Holder of a Warrant Certificate, without the consent of the Warrant Agent, the Trustee, the holder of any Offered Securities or the Holder of any other Warrant Certificate, may, in its own behalf and for its own benefit, enforce, and may institute and maintain any suit, action or proceeding against the Company suitable to enforce, or otherwise in respect of, its right to exercise its Warrants in the manner provided in its Warrant Certificate and in this Agreement.

Enforcement of Rights. (a) Notwithstanding any of the other provisions of this Warrant Agreement, any Holder of a Warrant CertificateCertificates or holder of Warrant Shares, without the consent of the Warrant Agent, the Trustee, the holder of any Offered Securities or the Holder of any other Warrant Certificate, may, in its own behalf and for its own benefitbehalf, enforce, and may institute and maintain any suit, action or proceeding against the Company suitable to enforce, or otherwise in respect of, its right to exercise the Warrant or Warrants evidenced by its Warrants in the manner Warrant Certificate as provided in its such Warrant Certificate and in this Warrant Agreement.
