Energized Date. The Energized Date shall not be earlier than the Earliest Energized Date as indicated in the System Identification Form. The System must be completely Installed, Energized and registered with PJM-EIS GATS or M-RETS by the Guaranteed Energized Date as set forth in the System Identification Form or any extension approved by the Buyer at its sole discretion, which shall be exercised reasonably. Seller may request a six-month extension of the Guaranteed Energized Date upon demonstration of project delays that do not otherwise jeopardize the successful completion of the System; any such extension will be granted at Buyer’s sole discretion, which shall be exercised reasonably. Any such requests will be determined by Buyer on a case by case basis, but will be limited to circumstances outside the bidder’sSeller’s control. Such circumstances may include delays in approval of interconnection requests, issuing of permits, and other events driven by delays in third-party processes.

  • Date Whenever any payment due hereunder shall fall due on a day other than a Business Day, such payment shall be made on the next succeeding Business Day, and such extension of time shall be included in the computation of interest or fees, as the case may be.
