Common use of Employment Termination Due to Death Clause in Contracts

Employment Termination Due to Death. If the Participant’s employment with the Company or any of its Subsidiaries terminates prior to the End Date as a result of the Participant’s death, the Service Condition shall be deemed fully satisfied as of the date of such termination, and, subject to paragraph 6(a), the PSUs shall remain subject to the Performance Condition.

Employment Termination Due to Death. If the Participant’s employment with the Company or any of its Subsidiaries Affiliates terminates prior to the End Date as a result of the Participant’s death, the Service Condition shall be deemed fully satisfied as of the date of such termination, and, subject to paragraph 6(a), the PSUs shall remain subject to the Performance Condition.

If the Participant’s employment with the Company or any of its Subsidiaries terminates prior to the End Normal Restriction Lapse Date as a result of the Participant’s death, the Service Condition shall be deemed fully satisfied as of the date of such termination, and, subject to paragraph 6(a)6a, the PSUs shall remain subject to the Performance Condition.
