Common use of EMBODIMENT Clause in Contracts

EMBODIMENT. ‌ The Agreement expressed herein in writing constitutes the entire agreement between the parties and no oral statement shall add to or supersede any of its provisions. The parties acknowledge that during the negotiations which preceded this Agreement each had the unlimited right and opportunity to make demands and proposals with respect to any subject or matter not removed by law from the area of collective bargaining and that the understandings and agreements arrived at by the parties after the exercise of that right and opportunity are set forth in this Agreement. Therefore, the City and SAFO for the life of this Agreement, each voluntarily and unqualifiedly, waive the right, and each agree that the other shall not be obligated, to bargain collectively with respect to any subject or matter referred to, or not settled, during the course of these negotiations. Such matters or subjects shall also not be subject to the grievance procedure. During the life of this Agreement, maintenance of contract items shall be processed through the provisions of the Supplemental Agreement.
